     This is  a new FY 08  Capital Budget Request. To  repair the                                                               
     backlog  of maintenance  items that  cannot be  done through                                                               
     the  operating  budget  funding levels.  Typical  items  are                                                               
     pavement  repairs, lighting  repairs,  fencing repairs,  and                                                               
     bird and  animal controls. This  project contributes  to the                                                               
     Department's  Mission by  reducing injuries,  fatalities and                                                               
     property damage and by improving  the mobility of people and                                                               
     goods.                                                                                                                     
                                                                                                                                
Ms. Slagle stated that these funds would be expended for                                                                        
projects that were typically not eligible to receive federal

Ms. Slagle reported that some vessels were approximately 40 yrs                                                                 
old. As the vessels age, they required more maintenance and                                                                     
repairs.                                                                                                                        
                                                                                                                                
Ms. Slagle told of US Coast Guard requirements to dismantle                                                                     
propellers to demonstrate they still functioned.

Co-Chair Stedman asked the reason this item had been amended

Ms. Slagle replied that the  new Palin Administration intended to                                                               
review  the  total  need  of the  system  before  submission  for                                                               
federal funding.  This was  not a  declaration that  the original                                                               
funding requested was not required.                                                                                             
                                                                                                                                
Ms. Slagle also  indicated the funds would be  utilized for shore                                                               
facilities  and  docking  facilities,  as well  as  security  and                                                               
safety aboard the ships. This would include fire equipment.

Senator  Dyson surmised  that many  capital projects  appeared to                                                               
have adequate  projections of future  budgets. He asked  why this

Ms.  Slagle  answered that  the  marine  vessels were  aging  and                                                               
therefore   prediction  of   the  exact   needs  was   difficult.                                                               
Supplemental budget  requests had  been made to  address specific                                                               
needs  relating to  electrical systems,  propellers, engines  and                                                               
other  equipment.  The  estimated  future  budgetary  needs  were                                                               
similar to the amount requested in this item.

Co-Chair Stedman  understood that the newly  appointed admiral of                                                               
the  fleet  had  been  directed  to  address  the  Committee  the                                                               
following  legislative  session  about the  long  term  projected                                                               
costs to operate  the ships. This briefing  would include ongoing                                                               
maintenance needs and repairs as  well as expenditures on efforts                                                               
to avoid unforeseen large expenses.

Senator  Dyson expressed  interest in  the future  of the  Marine                                                               
Highway  System.  The  experience   with  the  fast  ferries  was                                                               
"mixed". A  task force should  consider whether the  system could

Co-Chair  Stedman  reiterated that  in  January  2008, the  Palin                                                               
Administration would  appraise the  legislature of the  status of                                                               
the system  and plans  for its  future, including  performance of                                                               
the   fast  ferries.   Interest  had   been  expressed   by  some                                                               
legislatures to assign an independent  body to review the system.                                                               
All parties  recognized that  "what's been going  on in  the last

Senator Dyson understood that some  labor contracts prevented the                                                               
Department  from   implementing  changes  to  provide   the  best                                                               
management  and the  best service.  Proposed improvements  should                                                               
not  be   considered  "blindly"  without  accounting   for  these

Department  overview   include  the   impact  of   labor  issues,

     Replace  equipment through  a usage  fee charged  to capital                                                               
     projects.  Types   of  equipment  to  be   replaced  include

     copiers, plotters  and computers. The project  will also pay                                                               
     for  ineligible  usage  rate costs  reimbursed  through  the                                                               
     Indirect Cost Allocation Plans.  This project contributes to                                                               
     the  Department's Mission  by reducing  injuries, fatalities                                                               
     and property damage and by  improving the mobility of people

Senator  Elton  noted the  reference  to  "ineligible usage  rate

Ms. Slagle  told of the  process in  which a percentage  rate was                                                               
levied  on  all  construction   projects.  Most  of  the  capital                                                               
projects  undertaken by  the Department  utilize federal  funding                                                               
and  the Federal  Highway  Program  did not  allow  the State  to                                                               
charge equipment  purchases to construction  projects. Therefore,                                                               
the Indirect Cost  Allocation Plan is employed to  fund the costs                                                               
to support and administer the federal construction program.

Senator Dyson  inquired about the  final sentence in  the summary

summary  statements of  most  of the  funding  request items.  It                                                               
indicates  the  Department's  primary   goal  of  developing  and

Mr.  Mackinnon disclosed  that the  Department had  "extended the                                                               
life" of its computers from three  to four years. He assured that                                                               
the  funds were  not requested  for "buying  Cadillacs". However,                                                               
replacement  equipment would  have "certain  ergonomic features",                                                               
as  research  has  shown  that  long  term  use  reduced  workers

Mr. Mackinnon affirmed that the  Department made efforts to avoid                                                               
such   actions.   Federal    Occupational   Safety   and   Health                                                               
Administration (OSHA) inspections were  conducted in remote sites                                                               
for the purpose of meeting  with all employees to discuss safety.                                                               
A reduction of  69 percent in the number  of workers compensation                                                               
claims has been experienced in the last three years.

     This is  a new  FY 08 Capital  Budget Request.  This request                                                               
     provides  deferred  maintenance   funding  that  will  allow                                                               
     eligible  municipalities to  take ownership  of state  owned                                                               
     harbor  facilities in  accordance  with  AS 35.10.120.  This                                                               
     project contributes to the  Department's Mission by reducing                                                               
     injuries, fatalities  and property  damage and  by improving                                                               
     the mobility of people and goods.                                                                                          
                                                                                                                                
Ms. Slagle told of the transfer  of more than 70 harbors to local

Co-Chair  Stedman asked  whether the  Department would  undertake                                                               
replacement of the  facility located at Warm Springs  if the City                                                               
and Borough of Sitka declined to accept ownership of the harbor.

Ms.  Slagle had  been told  by  the city  administrator that  the

Co-Chair Stedman  stressed the  need for  a firm  commitment from                                                               
local governments to assume ownership  of these facilities. Users                                                               
of the Warm  Springs harbor paid no user fees.  He suggested that                                                               
unless responsibility  was transferred to local  governments, the                                                               
Department not replace the existing  facilities but rather remove                                                               
them  when  they became  deteriorated.  He  predicted that  users                                                               
would  then  be  willing  to   contribute  to  the  cost  of  the

Mr. Mackinnon  reminded that  in conjunction  with a  recent bond                                                               
proposal,  voters   approved  the   devolution  of   some  harbor                                                               
facilities  to   local  governments.  The  Department   had  some                                                               
difficulty in  convincing local governments to  assume ownership.                                                               
However,  when informed  that the  facilities would  otherwise be                                                               
surplus, the local governments all  agreed to accept ownership. A                                                               
similar  situation  occurred  with  a  facility  located  at  the                                                               
Petersburg harbor.

Co-Chair Stedman pointed out that  users of the Petersburg harbor                                                               
paid moorage  fees, while no fees  were paid for moorage  at Warm                                                               
Springs. He found State-funded improvements  for the Warm Springs                                                               
facility in  which users  refused to  contribute "objectionable."                                                               
If the  City and Borough  of Sitka  were to assume  ownership, he                                                               
supported the improvements. Otherwise,  he would not support this

Co-Chair Hoffman  cautioned of  the impact of  an "arm  twist" by                                                               
the  State on  some  communities to  assume  ownership of  harbor                                                               
facilities.  Use of  the  facility at  Bethel,  for example,  was                                                               
necessary to contain  the cost of living. He  understood the need                                                               
to  impose  user fees  for  facilities  in communities  that  had                                                               
alternative  transportation methods.  However,  the community  of                                                               
Bethel should not be "strong armed".

Mr. Mackinnon  agreed the situations  at Warm Springs  and Bethel                                                               
were different.  Regarding the Bethel harbor  facility, he stated                                                               
"there is  no option but  to make the repairs."  An appropriation                                                               
for  this  effort  was  made  three  years  prior  that  included                                                               
transfer  to  local  ownership. However,  the  amount  was  "very                                                               
insufficient"  to  accomplish  the  maintenance  and  repairs.  A                                                               
revised plan  was formulated  with the  assistance of  the harbor

in remote  areas of Southeast  Alaska that served "three  to four

     Competitive grants  for coordinated  transportation services                                                               
     for Mental Health Trust  beneficiaries whenever possible, or                                                               
     purchase  of vehicles  for  beneficiaries where  coordinated                                                               
     services are not yet available  or appropriate. This project                                                               
     contributes  to the  Department's Mission  by improving  the                                                               
     mobility of people and goods.                                                                                              
                                                                                                                                
Ms.  Slagle  exampled   the  Caravan  service  in   Juneau  as  a                                                               
coordinated   community  transportation   system  that   assisted                                                               
elderly  and   disabled  people  with  transportation   from  one                                                               
location  to another.  This  funding would  also  be utilized  to                                                               
provide transportation  during hours in which  these systems were                                                               
not  operating, as  well as  providing  transportation in  remote                                                               
areas  and   communities  without   a  coordinated   system.  The                                                               
Department  entered  into  agreements   with  taxi  companies  to

     This is  a new  FY 08 Capital  Budget Request.  The 415-mile                                                               
     long Dalton  Highway is the sole  ground transportation link                                                               
     to  the revenue  lifeblood of  Alaska, the  North Slope  oil                                                               
     fields. Over  the last two  decades the roadway  surface and                                                               
     roadside drainage structures have  fallen into disrepair due                                                               
     to  insufficient funding.  This project  contributes to  the                                                               
     Department's  Mission by  reducing injuries,  fatalities and                                                               
     property damage and by improving  the mobility of people and                                                               
     goods.                                                                                                                     
                                                                                                                                
Ms. Slagle  noted this was  the third funding request  related to                                                               
this project.  Funds would be utilized  for guardrail replacement

Senator  Olson asked  if the  need for  repairs was  a result  of                                                               
increased traffic  occurring on the  road with the change  to the                                                               
bypass  mail   delivery  from   air  transportation   to  surface

Mr. Mackinnon replied that an increase in traffic had been                                                                      
noted; however, the change in mail delivery service had only

     Transportation  and  Public Facilities  (DOT&PF)  maintained                                                               
     facilities.  This project  contributes  to the  Department's                                                               
     Mission  by  reducing   injuries,  fatalities  and  property                                                               
     damage and by improving the mobility of people and goods.                                                                  
                                                                                                                                
Ms.      Slagle      cited     the      accompanying      Project                                                               
Description/Justification, which reads as follows.                                                                              
                                                                                                                                
     The  department is  responsible  for 700  buildings, 1.3  of                                                               
     which are  over 30 years old  (some are from the  1940's and                                                               
     1950's).  The department  maintains 4.2  million sq.  ft. of                                                               
     buildings  including  office buildings,  maintenance  shops,                                                               
     employee  housing  and   equipment  storage  buildings.  The                                                               
     deferred  maintenance backlog  includes: roof  replacements,                                                               
     boiler   replacements,  sidewalk   replacements,  fire   and                                                               
     mechanical  code compliance,  repairs or  upgrades to  HVAC,                                                               
     electrical,   water   lines,    septic,   drain   and   fuel

     U.S.  Environmental  Protection  Agency  (EPA)  revised  its                                                               
     regulations governing storage of  fuel in above ground tanks                                                               
     requiring tank owners  to replace old tanks  with new double                                                               
     wall tanks and construct the  necessary means to protect the                                                               
     tanks.   Additionally,   Spill   Prevention,   Control   and                                                               
     Countermeasure  (SPCC) Plans  are to  be updated  or revised                                                               
     every  three years  according to  the new  regulations. This                                                               
     project contributes to the  Department's Mission by reducing                                                               
     injuries, fatalities and property damage.

utilized  to  make  improvements   to  dock  floatation,  gangway                                                               
repairs  and  other  deferred maintenance  projects  intended  to

district  he  represented.  The   harbor  at  Elfin  Cove  served

economy  based  on  mining,  and  the  dock  at  Funter  Bay  was                                                               
primarily used  to access recreational  cabins. However,  no user                                                               
fees were  collected for the  use of these three  facilities. The                                                               
State should  not be  furnishing these  docks at  no cost  to the

organized  a cooperative  to operate  a fuel  dock and  therefore                                                               
could assume ownership  of the harbor facilities.  Elfin Cove was                                                               
"active"  during  the  summer   months  with  commercial  fishing                                                               
activities and  a method in  which to  fund the facility  in that

     Replace the existing building or  re-side and paint existing                                                               
     building,  depending  on  funding available.  Without  these                                                               
     repairs,   the  Ester   Weigh  Station   will  continue   to                                                               
     deteriorate.                                                                                                               
     Sterling Weigh Station                                                                                                     
     Repair   and   maintenance.   Repair/replace   scale   deck,                                                               
     electrical  wiring in  pit, exterior  walls, window  hinges,                                                               
     cement slab, carpet and rubber  flooring, asphalt at scales.                                                               
     Permanently  install  chimney.   Paint  throughout.  Without                                                               
     these repairs,  the Sterling Weigh Station  will continue to                                                               
     deteriorate.                                                                                                               
     Potter Weigh Station                                                                                                       
     Repair   and  maintenance.   Refurbish  counter   handrails.                                                               
     Repair/replace  furnace, outside  halogen lights,  emergency                                                               
     light,  carpet, south  end door  auto  closer. Seal  window.                                                               
     Move "OPEN" flashing light switch  to front counter. Without                                                               
     these  repairs, the  Potter Weigh  Station will  continue to

     Tok Weigh Station                                                                                                          
     The weigh station  is currently slated to be  replaced in FY                                                               
     08.  If the  weigh station  is not  replaced, the  following                                                               
     repair  and  maintenance  would  need  to  be  done  on  the                                                               
     existing  weigh  station.  Move  sewer  and  septic  system.                                                               
     Install   heat   tape   in  sewer   lines.   Extend   eaves.                                                               
     Repair/replace bolsters in front  of building. Without these                                                               
     repairs,   the   Tok   Weigh  Station   will   continue   to                                                               
     deteriorate.                                                                                                               
     Glenn Inbound and Outbound Weigh Stations                                                                                  
     Repair and maintenance. Repave/patch  both parking lots. Add                                                               
     speed bumps  at scales  bypass lanes. Repair  water service.                                                               
     Install  guard  rails  in front  of  stations  for  employee                                                               
     safety.  Install  half-doors  at both  stations'  interiors.                                                               
     Paint the  bollards and trim  to department  colors. Replace                                                               
     deteriorated  signs with  new LED  signs  at both  stations.                                                               
     Without these repairs, the Glenn  inbound and outbound Weigh

appropriations  and interact  with  the  Palin Administration  to                                                               
forecast future appropriations. He  would share his findings with

Senator  Dyson told  of a  road project  located in  the election                                                               
district that  he represented in  which residents  disagreed with                                                               
the Department  on the magnitude  and impact of the  project. The                                                               
Department appeared  to disregard the concerns,  claiming that it                                                               
must  comply with  federal regulations  and expressing  intent to                                                               
proceed with the project as  originally planned. He described the                                                               
concerns with the proposed speed  limit, turn lanes that were too                                                               
wide  and bicycle  lanes located  on  both sides  of the  roadway                                                               
which would require removal of a vegetative barrier.                                                                            
                                                                                                                                
Senator Dyson deemed  the conflict a separation  of powers issue.                                                               
The legislature  and the Department  were "at loggerheads"  as to                                                               
the  policy.  He  philosophized  on  the  "voice"  granted  to  a

primarily on our  assets". Therefore if a bridge  was in jeopardy                                                               
due  to recurring  floods, the  Department would  make long  term                                                               
improvements   to   prevent   future   damage   from   occurring.                                                               
Responsibility for the residents in such  an area was held by the                                                               
Division  of  Emergency  Services,  although  the  Department  of                                                               
Transportation  and Public  Facilities has  assisted in  numerous                                                               
times of  disaster. Long  term solutions were  "at a  much higher

on  the road  project at  Eagle River  had been  discussed for  a                                                               
number  of years.  Senator  Olson asked  if  Mr. Mackinnon  could                                                               
foresee  a  practical solution  involving  greater  input at  the

Mr. Mackinnon recalled that the  intent language inserted for the                                                               
Eagle  River   Loop  project  in  the   previous  capital  budget                                                               
legislation  contained a  number  of design  elements, which  the                                                               
Department attempted  to address  and to  accommodate as  many as                                                               
possible.  Some  elements  could   not  be  incorporated  due  to                                                               
"certain  engineering  standards"  adopted for  "safety  issues".                                                               
Senator  Dyson   had  been  apprised  of   these  conflicts.  Mr.                                                               
Mackinnon  commented,  "I don't  know  if  it's  a good  idea  to                                                               
compromise safety for other reasons  other than safety." The only                                                               
"debatable" element  related to  the speed limit.  The Department                                                               
did not arbitrarily set the speed  limit; it was set to the speed                                                               
traveled at by  80 percent of the vehicles  utilizing the roadway                                                               
during  a  testing  period.  Studies  concluded  that  artificial                                                               
reduction  of the  speed  limit  resulted in  80  percent of  the                                                               
drivers  exceeding  that  limit,  which  becomes  an  enforcement
